myID.net Open API Terms of Service Agreement
Article 1. OBJECTIVES
- This Agreement is aimed at establishing basic terms and conditions applicable to the use of the service between NCsoft Corporation (‘Company’) and members of myID.net such as developers or service providers (‘Users’) who use myID.net Open API service (‘API service’) provided by the company.
- Given the fact that this Terms of Service Agreement is about use of Internet services, it is published on the myID.net website, or www.myid.net. When a user agrees to the terms, this agreement takes effect.
- The Users have the right not to agree to the changes to this Agreement, and if they do not agree to the changed Agreement, they may stop the use of the Service and cancel the membership. But, if the user does not notify the Company of his or her “disapproval” of the changes within fifteen days of the date when the changes made in a separately announced way specified in Paragraph 2 take effect, the user is deemed to agree to the changed Agreement.
- Issues not mentioned in this Agreement will follow the rules under myID.net Service Agreement and information and terms of use for myID.net service related to API service. Unless it is written clearly by developers and service providers that myID.net service refers to myID.net Open Application Programming Interface service (“API service”) or the API application or web service developed using API service, myID.net service is assumed to include API service and mashup service. In case the contents of this Agreement and other Agreements contradict, this Agreement overrules the others.
Article 2. DEFINITIONS
- The terms used in this Agreement are defined as follows.
- API service refers to the web service and application development service using Open API offered to Users by the Company aiming at facilitating free and creative service development through voluntary participation on the part of Users. Unless API Service or Mashup Service is specifically referred to, the service under this Agreement includes API Service and Mashup Service.
- API is an abbreviation of Application Programming Interface. It refers to a set of functions that define the capabilities provided by the Company and how to enable Users to use myID.net freely and to use the service on the application or web service Users establish.
- Mashup or mashup service refers to the application or web service created by Users using the Company’s API service after receiving application authentication key from the Company.
- Application authentication key refers to the unique identification key allocated to a mashup by the Company to make sure the Users gained permission to use API service from the Company and to identify the mashup made by the authorized Users.
- User authentication key refers to the unique identification key allocated to the end User of mashup to make sure the Users gained permission from the Company to use the mashup created by a third party and to identify the mashup user.
- The end user refers to a myID.net service user who approves access of a mashup service produced by a third party using the Company’s API Service to his or her account at the Service and uses the mashup service.
- The definitions of the terms used in this Agreement comply with relevant laws and other general business practices except those defined in Paragraph 1.
Article 3. API DEVELOPMENT AND HOW TO USE MASHUP
- Users should first sign up for myID.net service after agreeing to the Terms of Service Agreement. Then, Users can register the mashup to myID.net service provided by the Company using API service after agreeing to the Agreement and registration following procedure set by the Company.
- Users can develop or redistribute mashup using API service of myID.net freely.
- Users should be given application authentication key for mashup from the Company. Users can have access to API service of the Company by using the key.
- When producing mashup as stated in this Agreement using the Company’s API, Users should not combine, relate or link contents that; violate copyrights, trademark, patent and other Intellectual Property rights; are illegal and can disrupt social order; are immoral, sexually explicit, violent and contain repulsive material.
- The end user should be issued with user authentication key for mashup from the Company. Using the key, the Users can use mashup service made with the Company’s API service by the Company or a third party.
Article 4. LIMITATION OF SERVICE
- The Company can set the limitation of API service or mashup or determine special service hours or the number of times of service with notification in advance.
- When Users inflict damage on the Company’s operation and service by using API service offered by the Company and mashup service offered by a third party, the Company can cease the use of API or mashup of the Users.
- When Users violate the related laws, the Agreement or Service Use Criteria, the Company can cease API service or mashup use without having to notify the Users in advance regardless of the above condition.
- When Users attempt to launch illegal hacking against the Company and API and other services, use abusive methods or overuse the network, the Company can cease the Users’ mashup and API use upon notification of its own manner such as via e-mail.
- When issuing application authentication key for API service or User authentication key for mashup service, the Company can designate service period. The Company should notify Users when it wants to change the period no less than one month before.
- The User and/or end user may not open or share application authentication key and User authentication key to offer, assign, rent or use it as collateral for purposes other than providing it to use API and mashup services. Only the end user who received application authentication key and/or user authentication key can use them following the Agreement.
- The User and/or end user may not release application authentication key and/or user authentication key issued by the Company to a third party intentionally or otherwise or use them for purposes not stated in this Agreement. When the keys are released to a third party, the Company can cancel the User and/or end user’s rights to the keys. All legal responsibility for damages to the User and/or end user caused by the User and/or end user purposefully or accidentally rests on the User and/or end user.
- The company can limit the amount of daily request or traffic for application and/or user authentication keys. Detailed information on the limitation and traffic is notified on the myID.net service homepage (www.myid.net). In addition, when the Users use more service than the limit, he or she must consult the Company about it.
- When the Users withdraw from myID.net service and/or API service, they lose all rights to use service. The Users may not use any application authentication key issued by the Company or use any mashup related to the key. If, an end user used the mashup created by a User who withdrew from the service, the end user also may not use the mashup created by the withdrawn user in which case the Company takes no responsibility.
- The Company may come up with new rules concerning attempted abusing of service, overuse of network, damaging activities to the Company’s operation and other abusive use of service by the User and/or end user other than stated in this Article. The Company may also set actions (tentatively called “policy against abusive users”) against such abusive use of service by the Users and/or the end user and notify them on myID.net service homepage (www.myid.net).
Article 5. HOLDER OF INTELLECTUAL PROPERTY RIGHTS
- The copyrights for the mashup created by the Users using the Company’s API service are held by the Users only for the contribution made by the Users.
- The copyrights and other IPR for API service provided by the Company and the Company may change or stop API or API service in accordance with plans and conditions of the Company operation.
- In case the mashup is made through combining the API provided by the Company and by a third party, the Users should clearly indicate where they were used.
- The Company may use the mashup produced by the Users with API service for display, public relations or service advertisement which are deemed required in myID.net service and/or API service operation in accordance with myID.net Terms of Service Agreement and related laws.
- The copyrights for the product of API service is held by the Company and a third party. The approval of the Company for use for API service does not give the Users the copyrights or IPR for the end product of API service.
- The Users should observe the license set by the creator of the product of API service.
- The Users should clearly indicate that the mashup is made with “myID.net Open API” on the Company in accordance with the rules set by the Company. Detailed conditions for indication methods follow the notice on myID.net service homepage (www.myid.net) set by the Company.
- The Users are allowed to use API of the Company within the scope of use set by the Company. The Users are not allowed to use trademark/service mark, copyrights, patent rights and other IPR of the Company.
Article 6. LIMITATION OF COMPANY RESPONSIBILITY
- The Company does not take responsibility for the consequences caused by the Users’ use of myID.net API service and/or by the end user’s use of mashup service provided by a third party.
- The Company does not guarantee credibility, fairness, legality or profitability for the product of API service and/or mashup service of the Company.
- The Company does not take responsibility for the damages of the Users and/or the end user caused by inability to use API service and/or mashup service.
- The Company is waived of responsibility to provide service in case of natural disasters, interruption of infrastructure service during war, technical malfunction unable to be solved and other inescapable causes.
- The Company is waived of responsibility when service is interrupted or problems occurred due to maintenance, replacement, regular checkup, temporary checkup and construction of service facilities noticed in advance.
- The Users and/or the end user takes the responsibility for computer system damage or data and information loss caused by downloading or accessing certain program or information using the Company’s service based on his/her own decision.
- The Company does not take responsibility for the damages caused by the Users and/or the end user such as Users and/or the end user’s computer malfunction, incorrect personal information or e-mail address, failure to maintain password and/or application authentication key (and/or user authentication key).
- The Company is not responsible to intervene in conflicts between the Users and a third party over service and to pay the damages caused by the conflicts.
- The Company is not responsible when the Users and/or the end user is not satisfied with the service and is waived of responsibility for the damage caused by Users’ service use or choice.
Article 7. USE OF PERSONAL INFORMATION OR WITHDRWAL
- As part of maintaining API service and/or mashup service, the Company keeps record of Users and/or the end user’s myID.net ID in order to provide notices to the Users and/or the end user and to conduct research on service use under personal information and youth protection policies.
- The Company keeps only the information provided by the Users and/or the end user with their agreement and maintains tight control of the information under personal information and youth protection policies of myID.net service.
- When the User and/or the end user withdraws from service or when the User cancels registration of certain mashup, the Company assumes the agreement to provide personal information is withdrawn and ceases the mashup service.
- When the User and/or the end user stop using API service or withdrew agreement to provide personal information, the Company immediately discards the User and/or the end user’s personal information.
