myID.net Terms of Service Agreement
Chapter 1. GENERAL PROVISIONS
Article 1. OBJECTIVES
This Terms of Service Agreement is aimed at establishing basic terms and conditions applicable to the use of the service between myID.net service users (“Member”) using myID.net services (“Service”) provided by NCsoft Corporation (“Company”) and the Company.
Article 2. PUBLICATION, EFFECT AND AMENDMENT OF TERMS OF SERVICE AGREEMENT
- Given the fact that this Terms of Service Agreement is about use of Internet services, it is published on the myID.net website, or http://www.myid.net. When a user agrees to the terms, this agreement takes effect.
- The Company may change this Agreement at its discretion, and any changes to this Agreement shall be notified to the users via myID.net website or e-mail seven days before the changes take effect.
- The Member has the right not to agree to any changes to this Agreement, and if they do not agree to the changed Agreement, they may discontinue the use of and cancel the Service. But, if the user does not notify the Company of his or her “disapproval” of the changes within fifteen days of the date when the changes made in a separately announced way specified in Paragraph 2 take effect, the user is deemed to agree to the changed Agreement.
Article 3. NON-SPECIFIED RULES
If matters that are not specified in this Agreement are stipulated in relevant laws, the laws shall be followed.
Article 4. DEFINITIONS
- The terms used in this Agreement are defined as follows.
- “myID.net service” (“Service”) means an ID creation/management/authentication service that is designed to manage centrally IDs and user information needed to enjoy Internet services using Internet-based open standard technical specifications offered by the Company through the Internet, multimedia culture content equipment providers and PC communications. The Service includes API applications or Web services (“Mashup Service”) developed by developers and service providers using myID.net Open Application Programming Interface Service (“API Service”), and unless API Service or Mashup Service is specifically referred to, the service under this Agreement includes API Service and Mashup Service.
- “myID.net service users” (“Member”) means all users who have applied for service use with the Company and registered an account to use the Service via the Internet, multimedia culture content equipment providers and PC communications.
- “myID.net service account” (“Account”) means a combination of English letters and numbers that are selected by the Member and provided by the Company to identify the Member and allow the Member to use the Service.
- “myID.net service account information” (“Account Information”) means general information and service use information including user account and password.
- “Multimedia cultural contents equipment provider" means a public place of business equipped with machines like computers that are used to enjoy video games, watch video, or access a pool of information.
- The definitions of the terms used in this Agreement comply with relevant laws and other general business practices except those defined in Paragraph 1.
Chapter 2. SERVICE USE AGREEMENT
Article 5. USE AGREEMENT, APPLICATION FOR SERVICE USE AND ACCEPTANCE
- The Service Use Agreement takes effect when the user agrees to the Terms of Service at http://www.myid.net and the Company accepts the application. The Company accepts applications for service use in the order of application unless there is any problem with business process or any technical issue. However, when the Member applies for membership for services like Springnote or Lifepot, which are provided as a separate service or by a third party, he or she shall agrees to the Terms of Agreement of each service and go through a separate procedure for approval at the homepage of each service.
- The Member shall enter genuine information about himself or herself when applying for use under Paragraph 1. Those who do not enter real information may not only be legally protected but also have approval for use or the agreement cancelled by the Company in accordance with Article 6.
- The Company may put customized ads into the Service by using Member information for effective operation of the Service. Furthermore, the Company may send information mail about myID.net services to the Member who has approved e-mail receipt, and if the Member does not want to receive such e-mail, he or she may cancel mail receipt at http://www.myid.net anytime. Unless otherwise expressly specified, the Company may not provide Member information to a third party without a separate consent from the Member.
- The Member may demand withdrawal from the Service from the Company and when receiving such a demand, the Company shall immediately process the demand through procedures announced by the Company at http://www.myid.net.
- The Company may categorize the members into different classes, and offer different service contents regarding the length and time of service use, service menu, etc.
- If there is any change to the content of personal information entered when signing up for membership, the Member shall update the information immediately and may not hold the Company responsible for any damage occurring as a result of a delayed update.
- The Company may add or change categories of members or extra information demanded of the Member if it is necessary for the Service.
Article 6. RESERVATION OF USE AGREEMENT
- The Company may reject application for membership or terminate membership later if:
- the applicant applies for membership using a third party’s name; or
- the information entered by the applicant is wrong, insufficient, or misspelled; or
- the applicant does not qualify to use the Service based on the Company’s internal standards; or
- the applicant attempts to use the Service in an inappropriate way; or
- the applicant fails to meet the requirements for service use set by the Company; or
- the applicant attempts to use the Service to make profits; or
- the applicant applies for membership in violation of this Agreement or other relevant laws; or
- the application cannot be approved due to a cause attributed to the applicant.
- The Company may delay approving the application for membership until a cause for the delay is removed if:
- the Company judges that it cannot provide satisfactory services due to the lack of sufficient facilities; or
- the Company judges that registration for membership is hard to process due to major or temporary technical problems, like attack on the system; or
- an obstacle to service provision occurs
Article 7. TERMINATION
- The Member shall apply for withdrawal from membership personally via the Customer Center or the Personal Information Management Menu.
- The Company assumes that a member has withdrawn from membership if he or she has not accessed the Service for more than three months after signing up for the membership. In this case, the Company may alter the information of the relevant account and remove it. In this case, the Company may change or terminate relevant account information.
- Applicable to all accounts that have not been accessed for three months after signing up for the Service.
Chapter 3. OFFERED SERVICES
Article 8. CONTENTS OF SERVICE AND THEIR MODIFICATION
- The Company provides API Service, including mashup service, which is used to create, manage and authenticate ID and support use of other IDs. The Member can use services provided by the Company or those offered by a third party (“External Service”) with the ID for the Service. When the Member uses the External Service, the Company offers ID authentication and other related services as set forth in this Agreement.
- The Company gives its members notifications about service and line maintenance, a change to this Agreement, a change to the Service, Service management, events, an update or change to the Service, etc. through Notice at http://www.myid.net, so the Member shall check notifications at the homepage of myID.net. The Company shall not be held responsible for any damage done to the Member due to his or her non-checking of the notifications. However, if major and clear damage to the members is expected, the Company gives them a notification about the possible damage.
Article. 9 MEMBER ID AND PASSWORD
- The Company provides an account ID made up of a combination of English letters or numbers selected by the Member for the purpose of protecting the member’s information and offering information about service use.
- The Member cannot change his or her member ID while using this Service.
- Password is made by the Member personally, and if the Member wants, the password can be changed at any time.
- The use of the member ID can be discontinued at the request of the Member or at the discretion of the Company, if:
- privacy violation is expected as the member ID is made up of a phone number or a resident registration number; or
- the member ID is made up of words socially unacceptable and contrary to relevant laws; or
- the member ID is made up of characters that may violate a third party’s trademark rights or copyrights; or
- the member ID is deemed offensive or injurious to public morals; or
- the member ID is the same as the name of the Company, the Company’s service, or the service operator, may be mistaken for the name, or is derived from the name without any consent of the name holder.
- The responsibility for managing the member ID and password falls on the Member. The Member is totally responsible for any damage done to him or her due to careless management of the member ID or password or inappropriate use of them by a third party, and the Company is not held responsible for the damage.
- The Company may access, read and use (“connect”) an account of a member of myID.net through the member accounts of some services where the Company’s myID.net services like Springnote and Lifepot are operated by the Company. The IDs in the Service and other services of the Company are connected only when the IDs belong to a member. The ID is not connected with that of another member. In case the Company adds or deletes particular services whose IDs are connected, the Company shall give notifications about the fact at the homepage of myID.net or each service.
Article 10. HOW TO USE SERVICE
- The members may use the Service after agreeing to this Agreement and going through a particular registration procedure. However, the API Service can only be used after agreeing to myID.net Open API Terms of Service, a separate Terms of Service made by the Company.
- To use a particular mashup service, the Member shall use the mashup service use confirmation key (“User Key”), which is provided by the Company upon signing up for the Service, as an authentication method.
- The Member shall not provide, assign, lend, offer as a security to a third party or share with a third party the User Key, which is provided by the Company for the use of mashup service. Only the Member who is provided with User Key can use the Service in accordance with this Agreement.
- The Member can use the Service for a purpose or in a way announced by the Company separately, and in order to use the Service for the purpose and in the way mentioned above, the Member shall receive approval or confirmation in writing or via e-mail after notifying the Company of his or her intention in writing or in a similar way.
- The Company may come up with new rules concerning attempted abusing of service, overuse of network, damaging activities to the Company’s operation and other abusive use of service by the User and/or final user other than stated in this Article or in Article 11 under this Agreement. The Company may also set actions (tentatively called “policy against abusive users”) against such abusive use of service by the User and/or final user and notify about them at http://www.myid.net.
- The company can limit the amount of daily request or traffic for one User Key, and detailed information on the limitation is notified at the myID.net service homepage. In addition, in case the use of Service by the Member exceeds the limit set by the Company, the Member shall have to negotiate with the Company about the amount of service use.
Chapter 4. LIMITATION ON SERVICE USE
Article 11. DISCONTINUING SERVICE USE OR TERMINATION OF CONTRACT
- The Member can terminate the contract or demand discontinuation of service use owing to his or her personal circumstances.
- In case the Member wants to cease using the Service, he or she can demand discontinuation of service use to the Company through e-mail or other methods.
- The Company can limit, suspend or terminate membership of a member and the member ㅋcannot claim any rights regarding the Service if:
- he or she harasses, threatens, inflicts pain on, or inconveniences other members continually; or
- he or she falsely assumes the name of the official service operator or an executive of the Company, or operates an organization under the name of the Company; or
- he or she registers false information needed to sign up for membership, for example, by abusing another person’s information; or
- he or she violates laws, disturbs the peace and order of society and acts against public morals while using the Service; or
- he or she harms a third party’s rights or disturbs the order in electronic commerce like abusing information by using the Service; or
- he or she encourages the user to install programs unapproved by the Company, including Active X, spyware or adware without clear description about the purposes of the programs; or
- he or she provides, assigns, lends, offers the User Key as a security to a third party or shares it with a third party for purposes other than providing the Mashup Service with the User Key, which is offered by the Company for service use
- he or she encourages the visitors to the Service or other members to visit a particular site without their consent; or
- he or she corrects, make a second copyrighted work of, reverse-designs, or extract (de-complies) the source codes from the software offered to the Member as part of the Service, except when the Company allows for them in a separate Agreement.
- he or she uses the Service, to make profits, like selling IDs; or
- he or she does an act objectively deemed as a violation of relevant laws or association with crime; or
- he or she uses the Service for the purpose mentioned in No.1 or No.11 above.
- The Company shall give a member who needs to have his or her membership terminated a chance to make an excuse using e-mail or other methods within seven days of the notification about termination before execution of termination. Detailed matters about the procedure for making an excuse shall be based on the notice announced by the Company at www.myid.net.
- The Company can notify of any changes to the qualifications for the membership at the Service or at the External Service the relevant members sign up for and use utilizing the Service.
Article 12. LIMITATION ON SERVICE USE
- The Company can limit or discontinue all or part of the Service without any notice when natural disasters or other inescapable events occur or when such events are expected to take place.
- In case the Member fails to perform his or her duties, the Company can impose limits on the Service used by the member.
- The Company is not held responsible for any matters taking place between members within the scope of the Service while using the Service.
- The use of the ID can be restricted if the Member suffers a loss in the service use due to causes attributed to the Member’s carelessness, including ID and password leakage, or the duties of the Member are violated due to an inappropriate use of the Service by a third party.
- If the Company finds that the ID of a particular member is directly associated with an illegal act while investigating violation of duty set forth in Article 13 under this Agreement, the Company can suspend use of the relevant ID to protect rights of other members and maintain order in the Service. The relevant member can file an objection at the Customer Center at http://www.myid.net or via e-mail.
- Requests for consultation and queries about service use are processed via e-mail or other methods.
Chapter 5. DUTIES AND RESPONSIBILITIES OF PARTIES CONCERNED
Article 13. DUTIES AND RESPONSIBILITIES OF MEMBERS
- The Member shall enter real information, including a real name, into the account registered when applying for membership, and shall not provide false information. In case false information is entered or an account is registered under a fake name, the member cannot be protected by the Company in any way.
- The Member shall offer an available e-mail address or phone number when registering an account so that the Company can inform the member of matters necessary to use the Service.
- The Member shall not use for profits or let a third party use the Service or information obtained by using the Service without prior approval from the Company.
- The Member shall comply with provisions in this Agreement, other provisions set by the Company, notifications from the Company and relevant laws. The Member shall not use the myID.net Service for purposes other than original purposes or shall not:
- falsely assume the name of the service operator or an executive of the Company; or
- use a third party’s ID by stealth; or
- obtain another’s ID or authentication information by hacking the network, system, or PC; or
- sell, assign, establish the right of pledge against, offer as a security, or lend his or her ID, or advertise or prepare these acts; or
- produce IDs on a large scale in irregular methods like registering a program or hiring part-time workers; or
- use the Service utilizing a program bug or a similar thing; or
- disturb the business of the Company; or
- undermine the reputation of the Company; or
- harass, threaten, inconvenience a particular user; or
- encourage or provoke other users to do banned acts mentioned in Paragraph 1 and Paragraph 9.
- So as not disturb the peace and order of society and act against public morals, the Member shall not communicate with others about:
- committing a crime or encouraging such an act; or
- executing anti-national acts ; or
- disturbing social order and harming public morals; or
- undermining and violating a third party's reputation and rights; or
- swearing or engaging in sexually-explicit behavior; or
- defaming other members or provoking racial discrimination.
- The Member shall not assign or transfer the rights for using the Service or the status under the Service Use Agreement to a third party, or offer it as a security without prior definite approval from the Company.
- The Member is responsible for managing his or her ID and password.
- The Member shall not engage in commercial or advertising activities using the Service without approval from the Company and shall not engage in commercial or advertising activities beyond the scope and content approved by the Company, either.
- The Member shall not violate intellectual property rights of a third party. When producing a service or an independent program using the API Service, the Member shall not violate a third party’s intellectual property rights like copyrights, trademark rights, patents; include illegal, socially unacceptable, sexually-explicit, violent and repulsive contents in the service or program, or connect or associate immoral or illegal contents.
- The Member shall comply with this Agreement and relevant laws, and shall not engage in acts undermining the Company’s reputation or disturbing the business operation.
- The Member shall read notifications announced at http://www.myid.net from time to time.
Article 14. DUTIES AND RESPONSIBILITIES OF COMPANY
- The Company shall make best efforts to provide the Service continuously and stably. However, the Company may suspend the Service for reasons such as repair and maintenance of the IT facilities, breakdown, disconnection, regular checkup, and for other purposes necessary for the operation.
- The Company may conduct a regular checkup if necessary to offer the Service. The time of checkup is set by the notice announced at the homepage.
- The Company shall process opinions or complaints filed by the Member immediately if they are deemed reasonable. However, if it is hard to process them, the Company shall notify the Member of the reason and the schedule for processing.
Article 15. PRIVACY
The Company shall build a security system to protect private information, announce its privacy policy, which will be used as a guide for privacy protection.
Chapter 6. DAMAGE CLAIMS AND INDEMNITIES
Article 16. INDEMNITIES
- The free service provided by the Company is exempt from damage claims. The Company need not provide the Service when natural disasters, war, suspension of service by communications service operators, and other inescapable events take place.
- The Company shall not be held responsible for discontinuation or disruption of the Service taking place due to unavoidable causes such as repair and maintenance, replacement, regular checkup of which the Company has notified the users.
- The Company shall not be held responsible for discontinuation and disruption of the Service that takes place due to a cause attributed to the Member.
- The Company shall not be held responsible for damage done due to discontinuation or inconsistent provision of electricity or communications by the communications operators.
- The Company shall not be held responsible for damage done due to a cause attributable to the Member, including error of the Member’s computer, incorrect personal information or e-mail address, or careless management of the password.
- The Company shall not be held responsible for damage taking place due to the environment of the Member’s computer or the irregular network environment not attributed to the Company.
- The Company shall not be held responsible for reliability, accuracy, completion and quality of contents posted or transmitted on or via the Service and the Web.
- The Company shall have no duty to intervene in disputes between members or a member and a third party, which take place with the Service as medium, and shall have no responsibility to pay for any damage occurring as a result.
- The Company shall not be held responsible for an occasion where the Member fails to make expected profits, and is relieved of responsibility for any loss occurring as a result of using the Service.
Chapter 7. OTHER
Article 17. JURISDICTION AND GOVERNING LAW
- Lawsuits between the Company and the Member over the use of the Service are filed at a competent court in accordance with the Civil Proceedings Act.
- The lawsuits filed between the Company and the Member are subject to the law of the Republic of Korea.
